GENERAL TERMS AND CONDITIONS 

Scope

The general terms and conditions apply to all legal transactions between Iatroscope Sarl and its customers.

The contractual partner is Iatroscope Sarl (hereinafter "Seller").

Customer within the meaning of these Terms and Conditions may be consumers (hereinafter "Customer"). 

All deliveries and services shall be provided exclusively on the basis of the following General Terms and Conditions (hereinafter referred to as "GTC") in the version valid at the time of the order. 

Unless otherwise agreed in writing by both parties, the customer expressly accepts these as binding. The customer may not invoke its own terms and conditions of purchase.

Conclusion of contract

The provisions of these GTC apply to orders placed by consumers or companies via the website www.iatroscope.com of the online store Iatroscope.

The presentation and description of the goods on the website of Iatroscope Sarl does not constitute an offer of contract.

By ordering a product by clicking on the button "order with costs" at the end of the ordering process, a consumer makes a binding offer to conclude a purchase contract. Only with the dispatch of an order confirmation by e-mail by the seller, the contract is concluded.

The text of the contract is stored for orders. Customers receive an e-mail with the order data and the applicable GTC. After conclusion of the contract, the order data can no longer be viewed online. 

Payment

The statutory value added tax (VAT) and other price components are included in the stated prices. 

Shipping costs are not included in the displayed price and may be additional. We deliver with DHL, UPS etc. or another provider of our choice.

Payment can be made either in advance by bank transfer, by credit card (VISA, Mastercard), by instant bank transfer, by direct debit or on account.

We reserve the right to exclude individual payment methods.

 The purchase price shall bear interest at the rate of 5 percentage points above the prime rate upon the occurrence of default during the period of default.

Retention of title

Until full receipt of the purchase price, the seller retains ownership of the goods. 

Delivery

Delivery is made within 10 working days.

This period begins to run on the day after the payment order is issued.

All events for which the seller is not responsible, such as force majeure, entitle us to terminate the contract without the purchaser being entitled to compensation.

Liability

The seller is only liable for intent and gross negligence.

In other cases, we shall only be liable for slight negligence in the event of a breach of material contractual obligations. Material contractual obligations are obligations the fulfillment of which is essential for the proper performance of the contract and the observance of which the contractual partner relies on. Liability in the event of a breach of such a material contractual obligation shall be limited to the damage typical for the contract, the occurrence of which we had to expect at the time of conclusion of the contract on the basis of the circumstances known at that time. This limitation of liability shall also apply in favor of our vicarious agents.

The seller can in no case be liable for direct or indirect claims for damages.

Any financial complaint about the delivered goods is limited to the contract value.

Jurisdiction

The business relations are subject to Luxembourg law. The sole place of jurisdiction for all disputes arising directly or indirectly from the business relationship shall be the court of Luxembourg.
